Jonathan Band, ORI Copyright Counsel, appeared on a panel hosted by the Congressional Internet Caucus Advisory Committee to discuss reselling digital goods. Mr. Band discussed the complexities of digital resale and the need for a technologically neutral position. He also stressed that consumers deserve clarity when purchasing digital goods and shouldn’t be mislead when they are told they “bought” something when, in fact, a license is attached to the product. Mr. Band further highlighted the problem of essential software and the need to allow consumers to transfer physical goods with a digital component necessary for its’ operation.
